Modern-Day BarbarismThe Kobe Bryant sexual assault case continues to lurch forward, and most of my predictions have come true. The defense, headed by a woman, is launching a personal attack against the victim of unprecedented proportions. This legal assault goes far beyond the accused's right to a vigorous defense. The presence of blood, the presence of internal wounds, all prove beyond a reasonable doubt that violence was used during the incident.The intent of the defense is clear: intimidate the victim into withdrawing her charges. It is also having a chilling effect on rape reports throughout the country. According to the Denver Post, rape reports are down at the college Kobe Bryant's accuser attended. But this is of no consequence to the defense team. Nationally, only 16% of rapes and sexual assaults are reported to the police. And whenever this kind of re-victimization happens with national media attention, that percentage goes even lower. None of the defense's tactics should be allowed by the judge. In fact, they should all be covered under vastly strengthened rape shield laws. It's hard to believe that in 2004, women are still treated this way in the court system of America. 11:45 PM # |
